{"id":280,"date":"2026-05-27T23:31:49","date_gmt":"2026-05-27T21:31:49","guid":{"rendered":"https:\/\/solivalis.com\/terms-and-conditions-of-sale\/"},"modified":"2026-06-14T12:04:27","modified_gmt":"2026-06-14T10:04:27","slug":"terms-and-conditions-of-sale","status":"publish","type":"page","link":"https:\/\/solivalis.com\/en\/terms-and-conditions-of-sale\/","title":{"rendered":"Terms and Conditions of Sale"},"content":{"rendered":"\n<p>These Terms and Conditions of Sale (hereinafter &#8220;T&amp;C&#8221;) govern the contractual relationship between <strong>Solivalis<\/strong> and any adult individual wishing to purchase access to the paid version of the test (hereinafter &#8220;the Customer&#8221;).<\/p>\n<p>Any order placed on the site implies full and complete acceptance of these T&#038;C, in the version in force at the time of the order.<\/p>\n\n<h2>1. Seller Identification<\/h2>\n<p class=\"vendor-image\"><img decoding=\"async\" src=\"https:\/\/solivalis.com\/wp-content\/uploads\/vendeur-cgv-solivalis.png\" alt=\"Seller Identification\" style=\"max-width:100%;height:auto;display:block;margin:0\" loading=\"lazy\"><\/p>\n\n\n<h2>2. Purpose and Scope<\/h2>\n<p>These T&amp;C apply to the sale, by electronic means, of access to the paid version of the Solivalis personality test (hereinafter &#8220;In-Depth Profile&#8221;) and any associated features (including the &#8220;Gift&#8221; option).<\/p>\n<p>Use of the test is strictly reserved for adult individuals acting for personal, non-professional purposes.<\/p>\n\n<h2>3. Service Description<\/h2>\n<p>Solivalis offers a test combining two recognized scientific models (OCEAN and RIASEC), consisting of 92 questions. Two versions are available: <\/p>\n<ul>\n  <li><strong>Discovery Version (free):<\/strong> trait scores, Holland code, short descriptions.<\/li>\n  <li><strong>In-Depth Profile (paid, \u20ac4.90 incl. tax):<\/strong> detailed analyses (strengths, vulnerabilities, recommendations), personalized career paths, OCEAN \u00d7 RIASEC cross-analysis. Online access to the In-Depth Profile is maintained as long as the Customer logs into their account at least once every <strong>twelve (12) months<\/strong> (see data retention policy). <\/li>\n<\/ul>\n<p>The test can also be gifted to someone via the &#8220;Gift&#8221; option, at a unit price of \u20ac4.90 per recipient (VAT not applicable, Article 293 B of the French General Tax Code).<\/p>\n\n<h2>3a. Special Case of the &#8220;Gift&#8221; Option <\/h2>\n<p>When a Customer purchases an In-Depth Profile on behalf of a third party (&#8220;Recipient&#8221;) via the &#8220;Gift&#8221; option:<\/p>\n<ul>\n  <li>The contract is concluded between the publisher and the purchasing Customer, who alone is liable for the price. A single Customer may gift up to five (5) In-Depth Profiles simultaneously. <\/li>\n  <li>The Recipient receives a secure link by email allowing them to create their account and access the In-Depth Profile. Access is then maintained as long as the Recipient logs into their account at least once every twelve (12) months, under the same conditions as other accounts (see Article 3). <\/li>\n  <li>As long as the Recipient has not claimed the gift, the purchasing Customer retains the option to cancel the order under the conditions set out in Article 6.<\/li>\n  <li>Once the gift has been claimed by the Recipient, performance of the contract is deemed to have commenced and the purchasing Customer loses the option to cancel. The purchasing Customer is notified by email when the Recipient takes the test. <\/li>\n  <li>The Recipient&#8217;s account is governed by these T&amp;C, which they accept when creating their access.<\/li>\n  <li>The Recipient has six (6) months from the date of purchase to claim the gift. A reminder email is sent to the Recipient thirty (30) days before this deadline expires. Upon expiration, any unclaimed gift is considered expired. The purchasing Customer may, within this period, request a refund for the unclaimed gift by contacting customer service. After this period, no refund is possible.    <\/li>\n<\/ul>\n\n<h2>4. Pricing and Payment Terms<\/h2>\n<p>The price of the In-Depth Profile is <strong>\u20ac4.90<\/strong> (VAT not applicable, Article 293 B of the French General Tax Code), as a one-time payment, with no subscription or automatic renewal.<\/p>\n<p>Payment is made online by credit card via our payment provider <strong>Stripe Payments Europe Ltd<\/strong>. Banking data is processed exclusively by Stripe, in compliance with PCI-DSS standards. Solivalis has no access to complete banking details and does not store them.  <\/p>\n<p>The applicable price is the one displayed on the site at the time of the order. Any subsequent price changes have no effect on orders already placed. <\/p>\n\n<h2>5. Contract Formation<\/h2>\n<p>The order process follows these steps:<\/p>\n<ul>\n  <li>Taking the test (Discovery Version) and viewing the free results;<\/li>\n  <li>Clicking the &#8220;Unlock In-Depth Profile&#8221; button;<\/li>\n  <li>Automatic account creation using the email address provided during payment, or login to an existing account;<\/li>\n  <li>Express acceptance of these T&amp;C and the Privacy Policy (unchecked checkbox);<\/li>\n  <li>Express agreement for performance of the contract to begin immediately and express waiver of the right of withdrawal (unchecked checkbox\u2014see Article 6 below);<\/li>\n  <li>Payment validation via Stripe;<\/li>\n  <li>Order confirmation by email summarizing the essential elements of the contract.<\/li>\n<\/ul>\n<p>The contract is deemed concluded upon sending of the order confirmation email.<\/p>\n\n<h2>6. Right of Withdrawal<\/h2>\n<p>In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has in principle a period of fourteen (14) days to exercise their right of withdrawal.<\/p>\n<p>However, pursuant to <strong>Article L.221-28, 13\u00b0 of the French Consumer Code<\/strong>, this right cannot be exercised for contracts concerning the supply of digital content not supplied on a tangible medium, provided that two cumulative conditions are met:<\/p>\n<ul>\n  <li>The Customer has given their <strong>express prior consent<\/strong> for performance of the contract to begin before the end of the withdrawal period;<\/li>\n  <li>The Customer has <strong>expressly waived<\/strong> their right of withdrawal.<\/li>\n<\/ul>\n<p>These two consents (prior agreement + waiver) are collected simultaneously at the time of payment, by means of a single dedicated checkbox, separate from the checkbox for accepting the T&amp;C and Privacy Policy, and not pre-checked. The order confirmation email recalls, in writing, the Customer&#8217;s waiver of this right. <\/p>\n<p>Since the In-Depth Profile is accessible online immediately after payment, performance of the contract begins at that moment. The Customer therefore loses their right of withdrawal at that time, provided they have validated the two checkboxes above. <\/p>\n<p>By exception, in the case of a purchase via the &#8220;Gift&#8221; option (Article 3a), performance of the contract is deemed to begin when the Recipient claims the gift, not at payment. The purchasing Customer therefore retains their right of withdrawal as long as the gift has not been claimed. <\/p>\n\n<h2>6a. Refunds <\/h2>\n<p>For a purchase for oneself, since the In-Depth Profile is generated and accessible upon payment validation, the purchase is final, subject to the following.<\/p>\n<p>A refund remains possible in the following cases:<\/p>\n<ul>\n  <li>Double payment or multiple payment for the same profile;<\/li>\n  <li>Access not delivered after validated payment;<\/li>\n  <li>Confirmed technical error preventing use of the service;<\/li>\n  <li>Duplicate purchase of an In-Depth Profile for oneself: the system is designed to prevent a second purchase for the same account; if such a purchase occurs nonetheless, it is refunded.<\/li>\n<\/ul>\n<p>For a purchase via the &#8220;Gift&#8221; option, refunds follow the rules of Article 3a: the purchasing Customer may request cancellation and a refund as long as the Recipient has not claimed their gift. The Recipient has six (6) months to claim it; a reminder email is sent thirty (30) days before expiration. After this period, any unclaimed gift expires and is no longer refundable. When the Recipient takes the test, the purchasing Customer is notified by email; at that moment, performance of the contract is deemed to have commenced and the purchase becomes final.   <\/p>\n<p>Any refund request should be sent to customer service (Article 10).<\/p>\n\n<h2>7. Legal Guarantees<\/h2>\n<p>The Customer benefits, independently of these T&amp;C, from the legal guarantees applicable to digital content and services:<\/p>\n<ul>\n  <li><strong>Legal guarantee of conformity<\/strong> (Articles L.224-25-1 et seq. of the French Consumer Code): the service provided must correspond to the description given and function in accordance with the customary uses of a service of this type;<\/li>\n  <li><strong>Guarantee against hidden defects<\/strong> (Articles 1641 et seq. of the French Civil Code): applicable within the limits provided by law.<\/li>\n<\/ul>\n<p>In the event of non-conformity, the Customer may, free of charge, request that the service be brought into conformity and, failing that, a price reduction or termination of the contract under the conditions provided by law.<\/p>\n\n<h2>8. Liability<\/h2>\n<p>The publisher undertakes to exercise all necessary care in providing the service, within the framework of an <strong>obligation of means<\/strong>.<\/p>\n<p>Solivalis offers a test for informational and exploratory purposes. It cannot replace professional support when required (psychologist, career counselor). The publisher cannot be held liable for decisions made by the Customer based on the results provided.  <\/p>\n<p>To the fullest extent permitted by law, and except in cases of gross or intentional misconduct, the publisher&#8217;s liability is limited to the amount actually paid by the Customer for the order in question. The publisher cannot be held liable for indirect damages (data loss, loss of earnings, commercial harm). <\/p>\n<p>These limitations do not apply to the legal guarantees mentioned in Article 7, which remain fully applicable.<\/p>\n\n<h2>9. Personal Data<\/h2>\n<p>The methods of collection, use, and protection of the Customer&#8217;s personal data are detailed in our <a href=\"https:\/\/solivalis.com\/en\/privacy-policy\/\">Privacy Policy<\/a>, which forms an integral part of these T&amp;C.<\/p>\n\n<h2>10. Customer Service and Complaints<\/h2>\n<p>For any questions or complaints, the Customer may contact the publisher at: <a href=\"mailto:contact@solivalis.com\">contact@solivalis.com<\/a>. A response is provided within an indicative period of seven (7) business days. <\/p>\n\n<h2>11. Consumer Mediation<\/h2>\n<p>In accordance with the provisions of the French Consumer Code concerning &#8220;the consumer dispute mediation process,&#8221; after contacting us and in the absence of a satisfactory response, you have the option to use a free consumer mediation procedure with:<\/p>\n<ul>\n  <li><strong>CM2C<\/strong>\u2014Centre de la M\u00e9diation de la Consommation de Conciliateurs de Justice<\/li>\n  <li><strong>Address:<\/strong> 49 rue de Ponthieu, 75008 Paris<\/li>\n  <li><strong>Phone:<\/strong> 01 89 47 00 14<\/li>\n  <li><strong>Online submission platform:<\/strong> <a href=\"https:\/\/www.cm2c.net\" target=\"_blank\" rel=\"noopener\">www.cm2c.net<\/a><\/li>\n  <li><strong>Email:<\/strong> <a href=\"mailto:contact@cm2c.net\">contact@cm2c.net<\/a><\/li>\n<\/ul>\n<p>For cross-border disputes within the European Union, the Customer may contact the European Consumer Centre (ECC) France.<\/p>\n<p>For any dispute under five thousand (5,000) euros, recourse to an amicable resolution method (mediation or conciliation) is a mandatory prerequisite to any court action, in accordance with Article 750-1 of the French Code of Civil Procedure.<\/p>\n\n<h2>12. Retention of Invoices<\/h2>\n<p>In accordance with Article L.123-22 of the French Commercial Code, invoices and accounting documents related to purchases are retained by the publisher for a period of <strong>ten (10) years<\/strong>, even in the event of user account deletion. This retention fulfills a legal obligation and takes precedence over the right to erasure for strictly accounting data. <\/p>\n\n<h2>13. Force Majeure<\/h2>\n<p>Neither party may be held liable for failure to perform its obligations resulting from a case of force majeure within the meaning of Article 1218 of the French Civil Code. Force majeure suspends the parties&#8217; obligations for its entire duration; if it continues beyond thirty (30) days, the contract may be terminated automatically at the request of either party, without compensation. <\/p>\n\n<h2>14. Modification of the T&amp;C<\/h2>\n<p>The publisher may modify these T&amp;C at any time. The version applicable to each order is the one in force on the date of that order. In the event of a substantial modification affecting Customers with ongoing access, they are notified by email at least thirty (30) days before the new provisions take effect.  <\/p>\n\n<h2>15. Obvious Pricing Error<\/h2>\n<p>In the event of an obvious error in the displayed price (particularly an abnormally low price compared to the usual price or the value of the service), the publisher reserves the right to refuse the order. The Customer is notified without delay and may then choose between maintaining their order at the corrected price or canceling it free of charge. <\/p>\n\n<h2>16. Account Use<\/h2>\n<p>The customer account is strictly personal. The Customer is solely responsible for the confidentiality of their login credentials. Sharing the account with a third party is prohibited. In the event of fraudulent use or confirmed sharing, the publisher reserves the right to suspend or delete the account in question after warning, without prejudice to its right to retain sums already paid for the service performed.   <\/p>\n\n<h2>17. Applicable Law, Language, and Jurisdiction<\/h2>\n<p>These T&amp;C are governed by French law. The reference language of the contract is French: in the event of translation of the site into other languages, the French version prevails in case of divergence of interpretation. <\/p>\n<p>In the event of a dispute, and after an attempt at amicable resolution or mediation, the French courts shall have sole jurisdiction.
